Sexual Orientation, Gender Identity & the Law: A Research Guide

Introduction
This guide is intended to provide a starting point for research regarding sexual orientation and the law at the University of Tulsa
Mabee Legal Information Center. It includes both primary and secondary resources in a number of formats, including print, microform and electronic.
Getting Started:
When beginning a new research project, it is usually helpful to consult sources that can provide either some background or a
comprehensive overview of the subject you will be studying. Consulting these types of resources can help you understand the
issues involved in your research area and assist you in developing a list of search terms to use in your research. You may want to
consult legal periodicals, legal encyclopedias, or ALR annotations at this early stage of your research.
Periodicals
While there are a few legal periodicals that focus primarily on sexual orientation and the law (e.g. Law and Sexuality, Lesbian-Gay
Law Notes, etc.), you are likely to find individual articles on this
area of legal study in a great number of journals and law reviews.
The MLIC has both print and electronic periodical indexes, and any of
these can be used to look for journal articles on sexual orientation
and the law.
Print:
The Index to Legal Periodicals (1908 to date) and the Current Law
Index (1980 to date) can be found on the main floor of the MLIC in
the reference alcove. You may use either of these print indexes to
look for journal articles by title, subject, and author. These
indexes also provide both a Table of Cases and Table of Statutes
which will allow you to find articles discussing a particular case or
statute.
Symposium issues of law reviews focused on sexual orientation and the law may also provide a wealth of information. Some symposium issues in the MLIC's collection include:

LegalTrac is an index to articles in law reviews, specialty law
reviews, bar journals, and legal newspapers. It is the electronic
version of the Current Law Index mentioned above; however, it
includes more publications than the print index. (Most entries are
citations only. Some entries contain abstracts, and a few entries
have full-text.) Coverage is 1980 to date. Users can search by
keyword, subject, author, journal, and date. To access LegalTrac via
the MLIC homepage, select the link to "Research Tools," then select
"Electronic Subscriptions." Scroll down to LegalTrac in the list.

Legal Encyclopedias
The MLIC's legal encyclopedias are located on the third floor of the
building in the Mark S. Skaggs West Reading Hall. Our collection
includes both the first and second editions of American Jurisprudence
and Corpus Juris, two major legal encyclopedias. You will find an
index for each set at the end of the last main volume. Helpful
search terms in either encyclopedia might include:

If you are interested in sexual orientation as it applies to a
particular body of law, you might also use the index to find
information on the body of law you are researching. Some examples

Treatises and Hornbooks
Another way to get good background information on your topic is to
look through treatises and hornbooks which are secondary sources.
These sources often explain, analyze, or comment on the law, though
they are not the actual law itself. To find these resources in the
MLIC, you should use our online library catalog. You can search by
keyword, title, author, call number, or Library of Congress subject
heading. Some helpful Library of Congress Subject Headings may

Internet Resources
Primary Source Materials
After you have done some background research on your topic, you will
be ready to look at primary sources such as historical documents, cases,
statutes, and regulations. Since legal issues involving sexual orientation arise
in both state and federal matters, the following references will
guide you to both federal and state cases, statutes, and regulations.
Historical Documents:
Gay Rights Movement : Gay and Lesbian Politics and Social Activism : Periodicals and Newsletters. - This impressive microfilm collection, which spans from 1947 to 2004, contains 106 reels of material representing some of the earliest and most well-known publications of the LGBT community. This collection can be found in the northwest corner of the first floor of the MLIC in the microform cabinets. A guide to the collection's contents is located with the collection.
Federal Legislation:
The United States Code - both annotated and official versions of the
U.S. Code can be found in the MLIC's Main Reading Room. Because
sexual orientation and the law intersect in a number of instances, a
search of the general index for keywords pertaining to your research
issue is probably the best way to begin. Search terms may include:
- Armed Forces
- Hate Crimes
- Homosexual
- Marriage
You may also wish to consult the Popular Names Table in the set of statutes you have chosen to locate known federal legislation such as
the Defense of Marriage Act.
- Online versions of the U.S. Code - though only the print version of
the U.S. Code published by the Government Printing Office is
official, there are several reputable online sources where you can
find the U.S. Code. These include:

- Legislative Histories
- Selected legislative history for any individual federal statute
can be found by using the U.S. Code Congressional and Administrative
News (USCCAN), located in the Main Reading Room of the MLIC.

legislative history information. It is an electronic product

State Legislation:
Statutes for all 50 states can be found on the 1st floor of the
MLIC. Research strategies for state statutes are similar to those
described above for federal statutes. For questions about the
availability of state legislative histories, see a reference librarian.
Federal Regulations:
At the time of writing this guide, there are no major federal
regulations impacting gays, lesbians, bisexuals, and transgender
persons. However, should such regulations be adopted, researchers
may use the following sources and tools:
- The Code of Federal Regulations -can be found in the MLIC's Main
Reading Room.
- Online versions of the CFR-though only the print version of the
CFR published by the Government Printing Office is official, there
are several reputable online sources where you can find the Code of
Federal Regulations. These include:
- The Federal Register - current issues can be found in the MLIC's
Main Reading Room. Older issues are bound and placed on the 1st
floor of the MLIC in the government documents compact shelving.
- Online versions of the Federal Register-though only the print
version of the Federal Register published by the Government Printing
Office is official, you can also find the Federal Register online at: Government Printing Office http://www.gpoaccess.gov/fr/index.html
State Regulations:
The MLIC does not currently provide access to administrative codes
for all 50 states. The Oklahoma Administrative Code and Oklahoma
Register can be found in the Oklahoma Collection on the 2nd floor of
the MLIC in the Main Reading Room.

- Federal Reporter, Federal Supplement, Federal Appendix, Supreme
Court Reporter, United States Reports-each of these reporters can be
found on the 2nd floor in the Main Reading Room of the MLIC.
- Federal Digest (or Federal Practice Digest)-this case finding tool
can assist the researcher in finding cases relevant to sexual
orientation and the law. Users may consult the Descriptive Word
Index in the Federal Digest using search terms such as:
- Armed Services
- Child Custody
- Civil Rights
- Employment Discrimination
- Homosexuals
- Marriage
- Sodomy
State Case Law:
- Regional Reporters can be found on the 3rd floor of the MLIC in
the Main Reading Room.
- Regional or State Digests-Following the same process as described
above with the Federal Digest, researchers can use the Regional
Digests, located at the end of each set of Regional Reporters on the
3rd floor, or selected State Digests, located on the 1st floor with
other state-specific materials
